POLICY STATEMENT  

In this Credit Reporting Policy, Dataweavers Pty Ltd (ABN 57 630 717 494) is referred to as we, our and us. We recognise and respect that your privacy is very important, and we are committed to protecting the personal information we collect from and about you.  

The Privacy Act 1988 (Cth) (Privacy Act), the Australian Privacy Principles (APPs), and binding codes issued under the Privacy Act, govern the way we manage your personal information. Personal information is any information or opinion about a person, who is identified or reasonably identifiable, whether or not that information or opinion is true. 

This Credit Reporting Policy sets out how we collect, use, disclose and otherwise manage credit-related information.  

Our separate Privacy Policy sets out how we collect, use, disclose and otherwise manage other types of personal information.

COLLECTION   

Types of information collected   

If you apply for credit from us in the form of us providing you with services and allowing a time in excess of 7 days to pay for those goods or services, we may collect and hold various information related to your financial position. This may include ‘credit information’, ‘credit eligibility information’ and ‘CP-derived information’ (as those terms are defined in the Privacy Act).  

Credit information collected, may be given to a credit reporting body (such as Equifax Pty Ltd (Equifax)).  

This includes:  

  1. ‘Credit information’ is the information we may collect and give to a credit reporting body, including: 

  2. identity details;  

  3. the fact that you have applied for services from us, and  

  4. the fact that we are a credit provider to you.  

  5. ‘Credit eligibility information’ is the information credit reporting bodies provide to us.  

  6. ‘CP-derived information’ means any personal information that is derived from information provided to us by a credit reporting body. This could be, for instance, a credit score. 

In this Credit Reporting Policy, we refer to ‘credit-related information’ to capture some or all information related to your financial position such as credit that has been provided to you, or that you have applied for.  

Method of collection  

Where possible, we will collect credit-related information directly from you through the use of our standard forms, over the internet, via email, through a telephone conversation with you or in person.  We may also collect credit-related information about you from third parties acting on your behalf (for example, financial advisors).  

If we receive unsolicited information about you that we do not ask for or which is not directly related to our functions or activities, we may be required to destroy or de-identify that information, provided it is lawful and reasonable to do so. 

Purpose of collection 

We may collect and use your credit-related information in order to assess your financial position and your request for the supply of goods or services from us, for our internal management purposes and where otherwise required or permitted by law. 

Failure to provide information 

If the credit-related information you provide to us is incomplete or inaccurate, we will not be able to assess your application for a credit account and we may be unable to provide you with the services you are seeking. 

USE AND DISCLOSURE  

Disclosure to third parties and other organisations  

We may disclose credit-related information about you to:  

  1. a person who manages credit, to manage credit or for related internal management purposes that are directly related to the provision or management of commercial credit;  

  2. external dispute resolution providers; and  

  3. other persons where required or authorised by law.  

We may disclose your credit information to credit reporting bodies as set out in this Credit Reporting Policy from time to time. Details of how to obtain a copy of Equifax’s credit reporting policy are set out in the Notifiable Matters section below. 

Disclosure of personal information overseas  

We do not presently store credit-related information overseas, but we may disclose credit-related information to credit reporting bodies who engage other parties overseas. 

ACCESS AND CORRECTION 

You may access the credit information we hold about you, upon making a written request.  We will respond to your request within a reasonable period. Except where prohibited by the Privacy Act and Credit Reporting Privacy Code, we may charge you a reasonable fee for providing access to your personal information (but not for making a request for access). 

We may decline a request for access to credit information in circumstances prescribed by the Privacy Act, and if we do, we will give you a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint. 

To ensure you have access to the most up-to-date information, you should also request access to credit reporting information held by credit reporting bodies. 

If, upon receiving access to your credit-related information or at any other time, you believe the information we hold about you is inaccurate, incomplete or out of date, please notify us immediately.  We will take reasonable steps to correct the information within 30 days (or another time frame agreed with you in writing) so that it is accurate, complete and up to date. 

If we refuse to correct your information (for example, where it would be unlawful), we will give you a written notice that sets out our reasons for our refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint. 

COMPLAINTS AND FEEDBACK  

If you have any queries or concerns about our credit reporting policy or the way we handle your credit-related information, or you wish to make a complaint about a breach of the Privacy Act, the APPs, or the Credit Reporting Code, please contact us using the details below and we will take reasonable steps to investigate your complaint in accordance with our dispute resolution process, and respond to your queries and concerns within 30 days (or another time frame agreed with you in writing). 

If after this process you are not satisfied with our response, you can submit a complaint to the Office of the Information Commissioner.  To lodge a complaint, visit the ‘Complaints’ section of the Information Commissioner’s website, located at http://www.oaic.gov.au/privacy/privacy-complaints, to obtain the relevant complaint forms, or contact the Information Commissioner’s office.

STATEMENT OF NOTIFIABLE MATTERS UNDER THE CREDIT REPORTING PRIVACY CODE 

Under the Credit Reporting Privacy Code, there are several ‘notifiable matters’ that we are required to disclose to you at or before the time of collecting personal information that is likely to be disclosed to a credit reporting body.  

Those matters are:  

  1. the credit reporting body may include the credit information we provide to it in reports, which it then provides to other credit providers to assist those other credit providers to assess your credit worthiness;  
  2. if you commit a serious credit infringement, we may disclose this to a credit reporting body;  
  3. you can request a copy of this Credit Reporting Policy by contacting us, or obtain it directly from our website; 
  4. you can request a copy of Equifax’s credit reporting policy from its website https://www.equifax.com.au/privacy or by contacting them directly by mail to Equifax Public Access, PO Box 964, North Sydney, NSW, 2059;  
  5. you have the right to access credit information we hold about you, request that we correct the information, and make a complaint, as set out further in the remainder of this Credit Reporting Policy;  
  6. you can request a credit reporting body not to use your credit reporting information for the purposes of pre-screening of direct marketing by us; and  
  7. you can request a credit reporting body not to use or disclose your credit reporting information if you believe on reasonable grounds that you have been, or are likely to be, the victim of fraud.
